TERMS & CONDITIONS:

Year 2023

1.0 AMENDMENT:
  • The terms and conditions stipulated therein may be amended from time to time and published in the E-commerce website (Toola). Any such amendments shall be deemed to be effective and binding on a client and any subsequent use of our services shall be deemed to constitute acceptance of theses amended “Terms & conditions.” Any failure by Rofrah trading Ltd” and with trade name “Toola” to notify a client shall not prejudice in any way whatsever the validity and/or enforceability of the “Terms and conditions as so amended modified and/or replaced.
2.0 LAW:
  • The Terms and Conditions contained herein are constituted in accordance with the higher purchase acts, including the laws of the Republic of Kenya. The Courts of Kenya shall have Jurisdiction.
3.0 LIABILITY OF A CLIENT:
  • A client is adviced to read carefully the “Terms and Conditions” stipulated herein.
4.0 CIRCUMSTANCES BETORD THE CONTROL OF ROFRAH TRADING LTD:
  • Rofrah trading ltd (trading as “Toola”) shall bear no liability for inability to perform part or full obligations due to anything beyond or outside it control or partners.
5.0 COMMUNICATIONS:
  • Official communications between the issuing company to a client will be either through; telephone calls, letters/email or physical visit to an office /place of work.
6.0 WARRANTY:
  • Warranty is provided on moving parts and in case of a breakdown, “Toola” will repair & replace faulty parts. This however will be done after proof that the breakdown was not through negligence or misuse of the power tool, Equipment or Machinery.
7.0 LAST MILE DELIVERY:
  • A client is advised to double check whether the order being delivered to him/her by our agent is exactly as was ordered, it is unboxed, new and working soundly (before signing the last mile delivery form).
  • A client is encouraged to retain a copy of the Last Mile Delivery Form as proof of a delivery.
8.0 COLLATERAL:
  • The Power tool, machinery or equipment applied and delivered to a client forms the collateral of the loan and thus its ownership is retained by the issuing company up until when it’s fully paid for.
9.0 INSTALLMENTS:
  • All payments on agreed installments must be paid against stipulated dates without fail.
10.0 LATE PAYMENTS:
  • All late payment will accrue 10% penalties on top of agreed installments plans.
11.0 DEFAULTS:
  • A client will have been regarded as defaulted on servicing the loan and going against terms and conditions (stipulated) if he/she fails to pay installments at agreed dates and offers no oral or written explanation of the same within 14 days.
  • Failure to offer explanation or answer phone calls from our company (Rofrah Trading Ltd) will amount to having defaulted on the terms and conditions: at this point the company is at liberty to confiscate the power tool, Equipment or Machinery.
  • In case of Default on terms and conditions, a client is encouraged to surrender the power tool, equipment or machinery to a company agent or to the issuing company offices.
  • All returned defaulted for power tools, equipment’s or machinery must be in optimum working condition and mechanically intact before Rofrah Trading Ltd accepts them. Incase not, the refund will be rejected by the company and a recovery process instituted.
  • Recovery charges, expenses against a defaulted loan will be billed on a client.
  • All paid for installments will be lost by a client incase a return is made or Rofrah trading ltd successfully confiscates a defaulted for power tools, equipment or machinery.
12.0 OWNERSHIP:
  • The issuing company reserves the right of ownership of the power tools Equipment or Machinery issued to a client until the last installment is paid for and “Full payment”
  • Notification is communicated by the issuing company.
13.0 PRICES:
  • Quoted prices on issued power tools Equipment and Machinery will as at the time of issuing be stipulated and remain the same throughout the payment plan.
14.0 INTERESTS:
  • Interest, processing fees for the loan is pegged at 0%.
15.0 DELIVERIES:
  • All deliveries will only be made by “TOOLA” agents
  • A successful delivery must be accompanied by filled last mile delivery forms by the client.
16.0 PROMOTION:
  • I agree to “Toola” using my contacts details, images, photos to relay promotional messages directly to me or as they may wish.
